How to Evict Your Tenant in Chicago

  • File Your Case

    Chicago eviction cases are filed at the Daley Center in the Loop. An eviction currently costs $268 to file. You’ll need to file the certain paperwork at the clerk’s office and have the right amount of copies. Before you file your eviction, MAKE SURE you PROPERLY served a CORRECT eviction notice.  If you need an eviction notice, you can go here.

  • Sheriff's Office

    Nest you’ll head upstairs to the Sheriff’s Office. The Sheriff charges $60 per defendant to serve the court documents. Mind you, based upon our experience, they’re successful less than half the time. The Sheriff generally makes one attempt at serving the papers and you’ll usually know within about a week if they’ve served.

  • Court Date

    Now it’s time to return to court on the date you selected in the clerk’s office. Outside the courtroom you’ll find a sheet with your case listed on it. You’ll need the line number to the left. Once you get to court, check in with the clerk to the left or right of the judge’s seat. This is where the magic happens, because there are a few ways the case could go in most instances:

    • Your tenant may not show up
    • Your tenant shows up and you go to trial
    • Your tenant shows up and you settle the case
    • Your tenant shows up and asks for a continuance
    • You hire us and make things easier on yourself
  • What Isn't Covered

    We presented you with a simplistic view of the eviction process. Here are some things (in a non-exhaustive list) that could happen:

    • The Sheriff is unable to serve your papers
    • The tenant vacates your orders
    • The tenant files various motions
    • The tenant files a jury demand
    • The judge throws out your case because you didn’t follow the law
